Terms of service
Provider: WERBUNGMACHER.DE UG (haftungsbeschränkt), Bahnhofstraße 13A, 77767 Appenweier, Germany (details in the legal notice). GurbetciCard is a brand of WERBUNGMACHER.DE UG (haftungsbeschränkt), not a separate legal entity.
§ 1 Scope
These General Terms and Conditions apply to all orders of eSIM data packages placed through the online shop gurbetcicard.com by consumers within the meaning of § 13 BGB. Deviating terms of the customer do not become part of the contract unless we expressly agree to their application in writing.
§ 2 Conclusion of the contract
The presentation of the data packages in the shop does not constitute a binding offer, but an invitation to place an order. By clicking the order button during the ordering process, you submit a binding offer to purchase the data package in your basket. We accept your offer by means of a separate order confirmation by email or by providing your eSIM, at the latest upon provision. The text of the contract is not stored separately by us and can no longer be accessed via the shop once the order has been completed; you receive the order details with the order confirmation. The contract language is German or Turkish, depending on the language in which you completed the ordering process.
§ 3 Description of services
- We offer four eSIM data packages for the use of mobile data in Türkiye: 5 GB, 10 GB, 20 GB and 50 GB, each with a term of 30 days. The eSIM is a pure data tariff with a fixed data volume and a fixed term for one destination country, without its own telephone number and without a physical SIM card.
- After receipt of payment you will receive a personal installation link with a QR code and instructions by email. This installation link is valid for sixty days from your purchase, and you can set up your eSIM for the same length of time. The exact date is stated in your order confirmation, in every email relating to your order and at any time in your customer account at my.gurbetcicard.com.
- If you do not set up your eSIM within these sixty days, the installation link expires and with it your entitlement to the eSIM. There is no entitlement to a new link thereafter, and the purchase price paid will not be refunded: by that point in time the eSIM has been procured for you, provided and held available for you throughout the entire sixty days. Your statutory right of withdrawal remains unaffected by this; it is governed by our withdrawal policy and by paragraph 5. In individual cases we decide on a voluntary goodwill solution; there is no entitlement to this.
- So that the period fits your trip, you can buy your eSIM no more than fifty days before the start of your journey. You set up your eSIM after the purchase; it then remains on your device and only registers with a Turkish network when you arrive.
- Withdrawal and cancellation: fourteen days, as long as you have not set up the eSIM. Within fourteen days of your purchase you can cancel your order in your customer account and receive a full refund of the purchase price, as long as you have not yet set up the eSIM on a device. Upon set-up, our service has been performed in full; from that point in time cancellation is no longer possible, not even within the fourteen days. This presupposes that, when making your purchase, you expressly agreed that we may begin provision before the withdrawal period expires and confirmed that you thereby lose your right of withdrawal upon complete performance of the service (§ 356 para. 5 and para. 6 BGB). If you have not given this consent, your right of withdrawal remains in place for the full fourteen days. Details are set out in our withdrawal policy.
- The 30-day package term does not begin with the purchase and not with the installation, but with the first registration of your eSIM in a mobile network (e.g. when you switch on the mobile data connection after your arrival in Türkiye). If you switch on the eSIM before the start of your journey, your term begins at that earlier point in time.
- Within the running package term you can book an additional data package. Your eSIM remains a data eSIM without its own telephone number.
- If you order several eSIMs, you remain our contractual partner for all of them, even if you pass an eSIM on to another person.
§ 4 Prices and payment
- All prices shown are final prices in euros and include statutory VAT at the rate applicable at the time of the order. VAT is determined by your billing address, not by the country in which the eSIM is used.
- The purchase price is due upon conclusion of the contract and is processed via the payment methods offered during the ordering process. At present these are the payment cards offered via Shopify Payments as well as Shop Pay, Apple Pay and Google Pay. You can see which payment methods are available to you before you complete your order.
- If several eSIMs are ordered in one order, we grant an automatic discount of 5 per cent on the total price from the second eSIM onwards and of 15 per cent from the third eSIM onwards; the discount is applied automatically in the basket and at the checkout.
§ 5 Provision
- The eSIM requires an eSIM-capable, unlocked device. You can check whether your device is suitable before your purchase using the device check provided on the product page. The device check is an aid; we do not give any guarantee of the compatibility of your specific device.
- Provision takes place exclusively in digital form by sending the installation link by email; there is no dispatch.
§ 6 Availability and network coverage
- In Türkiye the eSIM uses the mobile network of a network partner of our provider; according to that provider's catalogue this is Vodafone Türkiye. Which network your device actually selects on site is beyond our influence; we therefore do not guarantee any particular network.
- The availability, speed and range of the mobile data connection depend on the location, the device and the local network and cannot be guaranteed. Fair use applies in accordance with the terms of our upstream network provider; where a specific usage limit exists for your package, it is stated on the product page.
- Data traffic via the eSIM may be routed through a technical network node outside Türkiye. Individual apps or services (e.g. banking apps) that require a Turkish IP address may therefore work only to a limited extent. We have no influence over this.
§ 7 Warranty
The statutory warranty rights for digital products under §§ 327 ff. BGB apply, in particular the provisions on defects in digital products (§ 327e BGB) and on the consumer's rights in the event of a defect (§ 327i BGB, including subsequent performance, price reduction and termination of the contract). The standard limitation period for claims based on defects is two years from provision (§ 327j in conjunction with § 438 BGB as applicable).
§ 8 Liability
- We are liable without limitation for intent and gross negligence as well as in accordance with the Produkthaftungsgesetz, and for injury to life, body or health.
- In the event of a slightly negligent breach of a material contractual obligation (cardinal obligation), the fulfilment of which makes the proper performance of the contract possible in the first place and on the observance of which you may regularly rely, our liability is limited to the foreseeable damage typical of this type of contract.
- In all other respects, liability for slightly negligent breaches of duty is excluded.
- We are not liable for outages, blocks or restrictions of the mobile network operated by third parties in Türkiye, insofar as we are not responsible for them.
§ 9 Contract term
The purchase of a data package is a one-off purchase. No subscription and no automatic renewal arise.
§ 10 Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
§ 11 Final provisions
- German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected by this, insofar as they apply under mandatory conflict-of-law rules.
- Should a provision of these terms and conditions be invalid, the validity of the remaining provisions remains unaffected.
